1. About these terms
Pichatech ("Pichatech", "we", "us") operates an online marketplace that helps people in Kenya discover tech products and repair services from independent shops. These terms govern your use of the Pichatech website, shop pages, checkout, order tracking and seller tools.
Pichatech is a venue. When you place an order, the contract of sale is between you and the shop that listed the item. Pichatech is not the seller of record, does not take ownership of the goods, and does not collect or hold the money you pay.
By using Pichatech you accept these terms. If you do not agree, please do not use the marketplace.
2. Eligibility and accounts
- You must be at least 18 years old, or have the permission of a parent or guardian, to place an order or open a shop.
- You agree to give accurate contact, delivery and payment details and to keep them up to date.
- You are responsible for activity under your account and for keeping your password private.
- We may ask for information to verify a shop before or after it starts selling.
3. Buying on Pichatech
Product listings, prices, stock, condition, warranty and delivery information are supplied by the seller. We display them as received and may remove listings that break these terms.
Placing an order creates a record for the seller and reserves stock. The seller may accept, fulfil or cancel the order, for example if an item is out of stock or the delivery address is outside their service area.
4. Paying the seller directly
Pichatech does not collect buyer payments. Each seller publishes their own payment details — an M-Pesa number, Paybill, Till number or bank account — and buyers pay the seller directly using those details.
Because money never passes through Pichatech, we cannot reverse, refund or hold a payment. Refunds and returns are handled by the seller under their return policy and Kenyan consumer law.
Always confirm the seller details shown on your order page before sending money. Keep your M-Pesa or bank confirmation message until the order is delivered. Never send money to a number that was not shown on your Pichatech order.
5. Prices, delivery and taxes
- All prices are shown in Kenyan shillings (KES) and include any taxes the seller is required to charge unless stated otherwise.
- Delivery fees are set by the seller or the delivery partner and are shown at checkout before you order.
- The seller is responsible for the accuracy of their prices, stock counts and tax obligations.
- Obvious pricing errors do not bind a seller; they may cancel the order and tell you why.
6. Seller obligations
- List only items you own or are authorised to sell, with accurate descriptions, photos, condition and stock.
- Honour the prices, delivery times and return policy you publish.
- Keep your payment details current and respond to buyer messages and order issues promptly.
- Package and deliver items safely, and comply with warranty, tax and consumer-protection law.
- Do not use Pichatech to collect money for goods you cannot or will not supply.
7. Prohibited items and conduct
You may not list or trade stolen goods, counterfeit products, weapons, drugs, hazardous materials, live animals, sexual content, or anything illegal in Kenya. You may not impersonate another shop, manipulate reviews, scrape the marketplace, or attempt to bypass our security or moderation.
We may remove listings, pause shops and report serious issues to the relevant authorities.
8. Promoted listings
Sellers may pay to promote products in marketplace placements. Promotions affect placement only; they do not change prices, reviews or the contract between buyer and seller. Promotion spend is separate from buyer payments and is handled by Pichatech.
9. Order issues and disputes
If something goes wrong, contact the seller first from your order page. Most issues — late delivery, wrong item, damaged goods — can be resolved directly.
If you cannot reach a resolution, open a dispute from your order page. Pichatech may review order records, messages and evidence, and may mediate or take action against a shop. We are not a party to the sale and cannot order a refund, but we can suspend shops that repeatedly break these terms.
10. Reviews
Reviews must be based on a real order and reflect your honest experience. We may moderate or remove reviews that are abusive, misleading, contain personal data, or are manipulated.
11. Intellectual property
The Pichatech name, logo, design and software belong to us or our licensors. Sellers keep ownership of their product photos and descriptions but grant us a licence to display them on the marketplace and in related marketing.
12. Availability and liability
We work to keep Pichatech available, but the marketplace is provided "as is" and may be interrupted for maintenance or by events outside our control.
To the extent permitted by law, Pichatech is not liable for the quality, safety, legality or delivery of items sold by shops, or for payments made directly between buyers and sellers. Nothing in these terms limits rights you have under Kenyan consumer law.
13. Suspension and termination
We may suspend or close an account or shop that breaks these terms, creates risk for buyers, or is required to be restricted by law. You may stop using Pichatech at any time.
14. Governing law
These terms are governed by the laws of Kenya. Disputes about the marketplace will be handled by the courts of Kenya, without limiting your right to complain to a consumer or data-protection authority.
